Using ShiftPal
Your private and professional life is important to us.
ShiftPal does not share any data with any third party.
No patient data is stored on the mobile device.
The application complies with all required standards in terms of security, encryption and data storage.
The comparative data of the application dashboard corresponds to all the data of all ShiftPal users in Quebec.
No ShiftPal user has access to nominal comparative data.
By using ShiftPal you agree that your anonymized data will be used to provide you with comparative and non-nominative data with that of your peers. These comparative data are of an informative nature only.
You are responsible for applying good data privacy practices during your shift while using your smartphone. You should always lock your device and allow access only with a password or biometric data.
ShiftPal is not responsible for potential data leaks resulting from bad practices on the part of a client user of the application.
Refund and cancellation policy
You must cancel before the end of the free trial period. Otherwise, no refund is allowed once the trial period is over. A plan cancellation allows you to keep access to the application until the end of the billing cycle, monthly or yearly, depending on the plan selected.
In the event of cancellation or cancellation of your subscription, access to the application is suspended. Your data is kept for a period of 3 (three) months after which it will be deleted. For any request to access your shift PDF reports once your subscription has ended, you must contact support to obtain it.
Automatic subscription renewal
Your subscription is valid until the end of the scheduled date of the chosen plan. You can cancel your subscription at any time as described above in the refund and cancellation policy.
When your plan expires, you will be notified of an automatic renewal of the subscription under the same terms of the already selected plan. To change or end the subscription, you will need to follow the instructions sent with the end of current plan and upcoming auto-renewal notice.

ShiftPal Detailed Privacy Policy

Article 1 - DEFINITIONS
a) APPLICABLE MOBILE APPLICATION: This Privacy Policy refers to and applies to the Mobile Application listed above, which will hereinafter be referred to as "Mobile Application".
b) EFFECTIVE DATE: "Effective Date" means the date on which this Privacy Policy comes into effect and takes effect.
c) PARTIES: The parties to this privacy policy are the following data controller: support@shiftpal.ca ("Data Controller") and you, as a user of this Mobile App. Hereinafter, the parties will be referred to individually as "Party" and collectively as "Parties".
d) DATA CONTROLLER: The Data Controller is the publisher, owner and operator of the Mobile Application and is the Party responsible for collecting the information described herein. The Data Controller is referred to either by the name of the Data Controller or by the "Data Controller", as indicated above. If the Data Controller or the Data Controller property is referred to by first-person pronouns, it will be by the use of the following terms: we, us, our, our, etc.
e) YOU: If you agree to this Privacy Policy and continue to use the Mobile Application, you will be referred to herein as either you, the user, or, if second person pronouns are necessary and applicable, by pronouns such as "your", "your", etc.
f) PERSONAL DATA: "Personal data" means the personal data and information that we obtain from you in connection with your use of the Mobile Application and which may identify you in any way.
Article 2 - GENERAL INFORMATION
This privacy policy (hereinafter "Privacy Policy") describes how we collect and use the Personal Data we receive about you, as well as your rights in relation to such Personal Data, when you visit our Mobile Application and interact with her in any way, including passively.
This Privacy Policy does not cover any information we may receive about you from sources other than the use of our Mobile Application.

Article 5 - MODIFICATIONS AND REVISION
We reserve the right to modify, revise or amend this privacy policy at any time and in any way. However, if we do, we will notify you and obtain your consent for the change in treatment. Unless we specifically obtain your consent, any change to the privacy policy will only affect the information collected from the date of the change. It is also your responsibility to periodically check this page for any such modification, revision or amendment.
Article 6 - PERSONAL DATA THAT WE RECEIVE FROM YOU
REGISTERED USERS:

Temporary session cookies are automatically deleted at the end of the browsing session - they are mainly used to identify you and ensure that you do not have to log in each time - while permanent cookies remain active longer than only one particular session.

LOG DATA: Like all websites and mobile applications, this mobile application also uses log files which store automatic information collected during user visits. The different types of log data can be:
- internet protocol (IP) address;
- type of browser and device settings used to connect to the Mobile Application;
- name of the Internet service provider (ISP);
- date and time of the visit
- user's home web page (referral) and exit;
- possibly the number of clicks.
The aforementioned information is processed automatically and collected in an exclusively aggregated manner in order to verify the proper functioning of the site, and for security reasons. This information will be processed according to the legitimate interests of the data controller.
For security reasons (spam filters, firewalls, virus detection), the automatically recorded data may also possibly include Personal Data such as the IP address, which could be used, in accordance with applicable laws, in order to block attempts to damage the Mobile Application or damage caused to other users, or in the event of harmful activities or crimes. This data is never used for user identification or profiling, but only for the protection of the mobile application and our users. This information will be processed in accordance with the legitimate interests of the data controller.
Article 8 - HOW PERSONAL DATA IS STORED
We use secure physical and digital systems to store your Personal Data where appropriate. We ensure that your personal data is protected against unauthorized access, disclosure or destruction.
Please note, however, that no system involving the transmission of information via the Internet or electronic data storage is completely secure. However, we take the protection and storage of your personal data very seriously. We take all reasonable steps to protect your personal data.
Personal data is stored throughout your relationship with us. We delete your Personal Data upon request for cancellation of your account or other general request for deletion of data.
In the event of a breach of your personal data, you will be notified within a reasonable time, but in no case later than two weeks, and we will follow all applicable laws regarding such breach.
Article 9 - OBJECTIVES OF THE PROCESSING OF PERSONAL DATA
We primarily use your Personal Data to help us provide you with a better experience on our Mobile Application and to provide you with services and / or information that you may have requested, such as the use of our Mobile Application.
Personal Data which can be considered as identifying can be used for the following:
a) Improve your personal user experience;
b) Notify you of updates to the Mobile Application or related items.
Article 10 - DISCLOSURE OF PERSONAL DATA
While our policy is to maintain the confidentiality of your Personal Data as described herein, we may disclose your Personal Data if we believe it is reasonable to do so in certain circumstances, in our sole and exclusive discretion. These cases may include, but are not limited to:
a) To comply with any local, state or federal laws or regulations;
b) To respond to requests, such as discovery, criminal, civil or administrative proceedings, subpoenas, court orders or subpoenas from law enforcement agencies or others government or legal bodies;
c) to take legal action against a user who has violated the law or the terms of use of our mobile application;
d) If this is necessary for the operation of our mobile application;
e) to cooperate generally with any legal investigation concerning our users;
f) if we suspect fraudulent activity on our mobile application or if we have noticed any activity that may violate our terms or other applicable rules.
Article 11 - CHOOSING NOT TO RECEIVE MESSAGES FROM US
From time to time, we may send you informative communications related to our mobile application, such as announcements or other information. If you wish to opt out of receiving these communications, you can contact the following email address: info@shiftpal.ca. You can also click on the opt-out link that will appear at the bottom of all such communications.
Please be aware that while you may opt out of these communications, you may still receive information from us that specifically relates to your use of our mobile application or your account with us.
By providing us with Personal Data, or using our Mobile Application in any way, you have created a business relationship with us. As such, you agree that any email sent by us or by affiliated third parties, even unsolicited, will not be considered SPAM, as that term is legally defined.

Article 13 - ACCEPTANCE OF RISK
By continuing to use our mobile application in any way, to use the product, you indicate your continued adherence to this privacy policy. You further acknowledge, agree and agree that no transmission of information or data via the Internet is always completely secure, regardless of the measures taken. You acknowledge, agree and agree that we do not guarantee the security of any information you provide to us, and that you transmit such information at your own risk.

Although the Competition Bureau is a government law enforcement agency, its objective is to ensure compliance with the Competition Act.
